"Tension is like a rocking chair which keeps you busy whole day but leads you nowhere."

You are happy, you are successful and then you need not to think anything other than you target. It is good to see own future with positivism but it is nice to have a positive action. Why to be in hell when there is a way to heaven, when there is a way to prosperity, when there is a way to the culmination of lovely life. Happiness is nothing but an open secret to the hump of a camel full of nectar. Happiness is something which emboldens your confidence culminating in grand success.

Why to loose on something just for negativism which is beyond control. Negativism is a straw that breaks the camel's back. Negativism is a state of mind which occupies the empire of minds for the sake of nothing. Negativism brings tension and "tension is like a rocking chair which keeps you busy whole day but leads you nowhere". So what is the remedy of  ultimate negativism which is caused by something measure of which seems impossible? I can argue you for taking a shelter of superstition. Yes superstition because it will deviate your mind from negativism. It will deviate your mind from the dark aura of a mirage which could lead you to a failure to compare between real and imaginary. It will lead you to the creativity provided you have full faith in the superstition you follow. Because faith is the real key to success. Take a shelter of superstition only if you  believe on it. Only if you have faith on it. Only if you have ever used it then only take a shelter of it. But this time differently. You are trapped in the aura of negativism due to the reason of failure and remedy of which still you want to find out but not getting any clue. 12 minutes seems like 12 decades and what is wrong if you take support of a non-living entity for passing the time and getting concentration on your job. What is wrong if someone finds seeing a flute early in the morning for smooth functioning during the daytime? What is wrong if someone finds seeing an idol during bed time for sound sleep? Nothing. Does it breach privacy of others? Of course not! 

I do not advocate for any thing which could harm any living entity or dis-balance the natural scenario, neither do I advocate for any insane behaviour which could lead to breach of peace in the locale nor do I advocate for any attitude due to which a human being could feel embarrassed. I only argue for such superstition by way of lucky charm in your pocket and/or yoga in your home which are eternal but short enough so that the world could not even notice. When putting an scarecrow in the open field is not sin then how keeping a lucky charm in your pocket could lead to sin? It is of course not! I argue for superstition which is the result of sane behaviour. I argue for superstition which has no duplicate meaning but only one that is to keep lucky charm or practice yoga which dose not lead to the breach of privacy of others, which does not lead to the disturbance of others by any means and rather which does not lead to disturbance in your own. 


Someone keeping umbrella with oneself irrespective of time, season, place or context is sin as it could disturb others, it could disturb the general rule of the locale but keeping a small idol in your any of the pocket could not be a sin. I am bringing you in the world of some of the popular superstition which I do not advocate you to follow but to have a knowledge of it. These superstitions in my view is not only unscientific but also unreasonable. In Britain no one take date Friday 13 auspicious since 19th Century but not to be confused with the Friday 13, number 13 is also symbolised for bad luck and in the same time horseshoe deems for good luck. In some part of Turkey you may think twice before chewing gum at night as there is a belief that chewing gum at night is actually rotting dead flesh. The writer of this line generally avoids using oil at night. The best selling novel, "Anne of Geierstein" written by Sir Walter Scott in 1829 laid a sense in general people that whose favourite stone is Opal is unlucky. During the quin Elizabeth's reign, ringing bell at auspicious occasions are mandatory for keeping evil spirits away. In Russia, there is a belief that defecation of bird at you, your car or at your property brings good luck. It is believed that crossing your way by black cats brings bad luck. During WWI, soldiers were not lighting 3 cigarettes from single match as it was deemed unlucky. Some populations believes that looking into a mirror steals your souls and hence those who are looking into mirror regularly are deemed to be soulless. You must have heard that someone while waiting for an outcome says that (s)he has kept her/his finger crossed which means (s)he is praying for good luck to come. When photography was first introduced in 19th century, it was believed that taking photography is akin to taking soul away from the body. Greeks and Europeans believes that wishing upon a falling star is lucky. Word Touch wood comes from a belief that knocking a wood means calling spirits for your protection. Saying God Bless You is a way of welcoming the person back to life as Pope Gregory the great say it to people who sneeze during a bubonic plague; and from the erroneous belief that the soul escapes the body during a sneeze and the heart momentarily stops. Itching palm possibly all of us know which means the person is greedy. If your right palm itches then it is believed that you would loose money, if left palm itches it would mean that you will gain money and if both palm itches then it is believed that your way to doctor is soon. 

Hence, I am not advocating any of the above superstition as it will take your time and energy both and those are not lucky charm neither yoga rather I would recommend if you agree to take small and short moment yoga practice in your daily life under the guidance of properly trained yoga teacher, shortly you would realise that your adranils are saved. You can use lucky charms like handkerchief and/or wallet size idol/cross/moon etc but please keep in mind that it should not disturb others in any way whatsoever. Getting happiness by disturbing others cannot be said an honest way of success.

Voting in and out someone cannot be a sin!

2014 General Election in India was no doubt a mass movement, a mass movement since 1977, a mass movement against the last refuse of scoundrel, a mass movement against the alleged corruption on the part of the leading political party at the helm of the government, a mass movement against the deteriorating law and order of the country and last but not least a mass movement against the center which was responsible for everything: Why the chief ministers are taking steps for development and why not, why is water supplied to the colonies and why not and why people eat in abundance and why not etc. The Citizen of India voted in mass and broke all the records of voting percentages. Voted in mass for change. Voted in mass for development. Youths and/or first time voters were overwhelming to throw out the incumbent. Everyone were promised of good days, good days in the form of employment, good days in the form of good governance, good days in the form of honesty, good days in the form of punishing the main culprit and rescuing the innocents, good days in the form of conservation of natural resources, good days in the form of conserving forests and environment, good days in the form of taming the inflation, good days in the form of border security etc. etc.      

Before the election, we have seen numerous mass protests against the government. A pressure tactics was used to pressurize government to succumb before the hidden plebiscites of some unauthorized group of activists. Activists like Anna Hazare and nexus were so desperate that the Indian Sovereignty was in danger or it was about to become a slave if Lokpal which later renamed Jokepal in sarcasm by some section of society or you can say a tool to destabilize the government or you can say a pan to bake your own bread,  is not appointed. Anna Hazare's supporters were so busy in to be enthroned that they were using all the possible means and opportunities to give a bit of their mind. All the sections of media were so busy in glorifying all of the bits of the activists in such a way as if it is portrayed that a single family of mother-son was usurping the constitution. Constitution of India which has deep root of democracy. Political game later appeared to be fixed but India witnessed a transformation in politics. One single party got the majority in 30 years on a promise of good days, a promise which was construed by the demagogues that no one shall have any work to do rather the government shall feed them

A government was formed and people were relaxed that now India is free from all hassle. Oh! No! Government is busy in some other work, other work which is unknown, opaque and full of strides. Voters who voted in was demanding their share of good days from the government now became an easy target of some section of society and situation is that sooty began to mock black chimney. Every time these innocent voters are remembered of the days before general election 2014 and taunted for good days on a pretext that the situation was worse and hence the government is incapable of providing any  quick relief.

Yes it is the right of each single voter irrespective of the fact that (s)he voted in the incumbent government or not to ask the government to be accountable. The henchmen are lynching the soul of the voters to shrinking from incurring an obligation. The voters cultivated the land of good days, irrigated, fertilized and sowed the seeds. Now vegetable has grown, plucked from the plant, kept in cold storage and the voters are asking their share so that they could dice the fresh vegetable and make into the pot for cooking. What is your problem Mr. Watchman? Why your men are arguing that this demand of good days is illicit? Why are they taunted of their poverty? Why are they shamelessly called the king of the world? Yes, they were the king of the World where dream was decided by them, of the world where they were told to do labour and decide their own shares, for the world which was dependent upon them, for the world where litterateurs were  listened. 

Litterateurs are returning their Awards on the protests that the government is not listening them and the cultural clashes round the corner are taking place. You know it better that winning a prize for any body is a moment which cannot be explained in words. I have seen Ms. Usha Uthup crying after receiving the first Filmfare Award for the best female singer. A litterateur is alone without award. No one recognizes him/her with courage. A sense of pity for him/her is prevailing in the society. (S)He is a living corpus, a living corpus who is scared with himself/herself, a living corpus whose nib is pointless, a living corpus who shall have oxygen of literary sense after receiving the proper redressal of the issues. They are returning their award only for a favour that guilty be punished with iron hand while cultural disharmony that is prevailing in the society be stopped. They won the award for writing the stuff to encouraging social harmony, encouraging cultural harmony and above all encouraging the national integrity. How can they see disintegration, disintegration of their values, disintegration of social values? 

They raise the voice and some "Gunda" type followers shut their mouth by saying they got no right to speak as they have not voted the incumbent government in. How come these "Gunda" know? What are the spiritual forces which inspires these "Gunda" to know who have voted in and/out? As only the voter know this. Don't you think this "Gunda" type people are encouraging "Chalta Hai" i.e. casual attitude? Don't you think this "Gunda" tyype people are tarnishing the image of the strong government formed after almost three decades or at least for grammatical error two decades? Don't you think this attitude is suicidal for any government/country/democracy? O.K. You are given an opportunity till 2019 so let us not talk on the same.

You must remember, Guruji Ravindranath Tagore returned the prestigious Knighthood Award to the Crown in 1919 in the wake of Jaliavala Bagg Kand. Was he wrong? Khushvant Singh returned Padam Samman in the wake of 1984 Sikkh Carnage. He was a Sikkh and hence there could have been every possibility that he would have vested interest in returnig the Samman despite at the same time was he wrong? Certainly not. Certainly not because both of them found no other way to pierce their sense of feeling in the ear of the government at their own separate time. 

Why not to beseech you to kindly listens to those who oppose you? Why not to beseech you to  kindly act on your Rajdharma/Reign? Why not to beseech you to kindly not to denounce a wrong person for saving some cultural ethos which is falsely in danger? Why not to beseech you to kindly cry the Litterateurs heart out to feel their pain once? Why not to beseech you to kindly walk the farthest way about which is nearest way home for social harmony? Why not to beseech you to kindly do not make your voters feel guilty for giving  a chance to newcomer? Why not to beseech you to kindly understand that your voters are wise enough to vote you in? Why not to beseech you to kindly make the society peaceful and try all the possible effort to resettle our Pandit brothers/sisters in K-Velly and bring all types of peace in the state of Punjab? That is it! Jay Hind! Jay Bharat!

Comparison of Sri Prakash Singh Badal with Nelson Mandela? - A Quick Review

Mr. Prakash Singh Badal first assumed the office of the Chief Minister of Punjab in June 1970 being the youngest Chief Minister of any Indian state. This is his fifth service and second consecutive term since 2007. He has been serving the state on very crucial occasions and the people of Punjab has deposed the greatest faith upon him then Mr. Narendra Modi, being CM, Gujarat, Mr. Lalu Prasad and others. To remain in politics for almost four decades is a charisma which is indisputable. I will talk of Mr. Badal only since his assumption of office in 1997. There is no need and indeed it is worthless to discuss any event before that.

Punjab is the biggest receiver of remittances from abroad and hence the abundance of money for leisure is always present there. I cannot argue and indeed do not want to involve in any argument this time of its goodwill rather this time is different and people make it tick. In 2006-07, Punjab was having NSDP of Rs. 113013 Cr. at 2004-05 price, a 3.20% of All India NDP while in it is Rs. 281128 Cr. at 2004-05 price, 3.02% which means India was heading and Punjab was beheading. While growth in NSDP in 2006-07 in Punjab was 17.8% over previous year, in 2013-14 it is 11.6%. I am arguing and counteracting with the facts and figures not to bring  the government at  back-foot but to bring at helm of development. The transparency in the government is negligible in terms of open government initiative led by UPA governemt which is now Digital India. 

In 2006-07 per capita NSDP of the state was 134.21% ahead of All India per - capita NNI and in 2013-14 it was 124.55% in terms of 2004-05 series. The people of Punjab lost here also. In terms of growth of Per Capita NSDP, the people was at a looser side as in 2006-07, the state witnessed 15.7% growth over the previous year, in 2013-14, it envisaged only 9.6%. Yes, state performed miserable in the able leadership of Mr. Badal but the sensational politics always blamed the Center which was breaking records in terms of high growth and achievement. 

Crime data of Punjab is not encouraging. Total 37162 incidence of Total Cognizable Crimes (IPC) During 2014 has been registered. 27812 Incidence & Rate of Total Cognizable Crimes (SLL) During 2014 has been registered. Situation of crime against women and children is also in desperation. 

Nelson Mandela was a political prison of slavery which of course Mr. Badal was not.

Chief Ministers of BUSUB can act good for peace and co-operation with Nepal - An Open Letter

Ms. Mamta Banerjee,
The Hon'ble Chief Minister of West Bengal,

Madam,

Your newfangled visit in Bhutan brings overwhelming response on both sides of Indo-Bhutan border and in the meantime, I take an opportunity to praise you as one of the most active Chief Ministers amongst Indian States. You are concerned with both; the state of West Bengal as well as you have same feeling of national interest. A lady of balanced oration is your identity. I first came West Bengal when CPM was in power and now you are leading this ancient and joyful state with the support of the majority: some of whom are loyal to you and some are liking you for your dedication and work towards the state. 

You are aware that in recent days our neighboring nation, Nepal, is upset with India for various reasons including but not limited to the over critical nature of politicians in rein. The over possessive patriotic nature of Madheshis who want my way or high way is the bitter spices of the upset within the Nepalese authorities. We must not forget that democracy in Nepal is the birth child of insurgency. Insurgency of last respected people, insurgency of those who were deprived of modern world and insurgency of those who basically had not even an iota of any idea. 

The world is decked out with a concept of anti-religious sentiments. Religious tolerance is now becoming an obsolete word and anyone advocating for the same are least tolerated. I would like to seek permission from the so called great leaders of the world that Dear Mr. Leaders, you have miserably failed before the CHEAP POLITICS of religion. You get a sample and apply it to population which is wrong. What are you going to gain? Can you, Mr. World Leaders, name me any politician who in modern days earned more name and fame than Lincoln. You cannot. You know why? Because my dear leaders, there must be a noble cause in your social life.

Madam, what I am going to discuss with you and want to tell the Hon'ble Chief Ministers of Bihar, Uttar Paradesh, Sikkim and Uttarakhand is the same. You are pro-active in International relations and hence I am directly addressing it to you. I have the same respect and honour for them as you have, But you are my Didi. I am confident that they will treat this letter as if this is addressed to them. Now coming to the point directly.

The constitution of India vide Article 51 empowers you, the Indian states through directive principle of the states to accord with an International Treaty with the neighboring country to (a) promote international peace and security, (b) have friendly relations with other nations, (c) foster respect for international law and treaty obligations and (d) encourage settlement of international disputes by arbitration. Now for the sake of clarity, I would like to submit before you that I have my eye open and I know Article 253 of our constitution makes our country some kind dualist in nature and according to this and quoting the words of Constitutional Expert, P.M. Bakashi, "International treaties do not automatically become part of national law. They have to be incorporated into the legal system by appropriate domestic law. Power to implement treaties belongs exclusively to the Union". And the Hon'ble Supreme Court of India many times have ruled that directive principles can override in case of interest of people at large is involved and also it can be put before you that the national legislature got power to pass any law contrary to the international law and that must be respected.   

When you work for the Madheshis and suggest a midway to end the clash, I do not think that the Union shall have guts to block the treaties you signed. You please take your own decision without any influence from the center as they have miserably failed on this issue and disputed the facts in such a way that none other than only Madheshis are looser. And yet, I have to say you, if so the center rejects your treaties, "normativist power ultimately remains with the people and therefore any functionary of a central power has to be an outcome of social contract." Social contract as your treaties shall be helpful for the Madheshis and will restore as well as uphold the long lasting relationship with the Neighboring Country, Nepal with whom our cultural ethos matches.

Adwait and The Grand Design

Once upon a time, it was argued that Hinduism is nothing but based upon the superstition and dogmatic belief and there is no God exists as believed. The first proposer of this view was Charvak. The Hindu Brahmans were shrewd enough and eschewed the concept by adding Charvak as Brihaspati, the Guru of Dev/Suras and this distinction between theist and atheist became so blurred that later on some people treated Gita as Hindu Book and someone like this blogger took the same as a constitution which teaches you self discipline and which teaches you that working is the last resort where you can rest upon. 

Then comes Gautam Buddha and again Brahmans made Him also one of the Avatars of the Parmatmah... Now it gives us a room of argument that Hinduism had broad concept of religion and never engaged in any tussle with any other religion and hence knot between Sikhism and Hinduism was much stronger. This blogger has not heard any news in any history about any tussle between Hindus and Sikhs. Hindus are following two paths of life: Dualists and Non-dualists. Dualists are believer in day -to - day affair and according to them God has same good kind of blender of love, fear and hatred as that of a living creature on the earth rather non-dualists are much stronger is their belief and they are nearer to atheist. They followed rule of law and according to Shankaracharya, there is no exception of the ruling of that Almighty. 

While being atheist, Stephen Hawking argued in his book titled, "The Grand Design" that the universe is ruled by law and there is no exception to  it. He proposed nothing but the ancient Indian culture where it is postulated that the rule of nature is the same to all and no one can be spared to it. Both dualists and non-dualists are agreeing with this point and hence dualists Hindus are worshiping stones, concretes, papers, rivers, rivulets, ponds, trees, sun, moon, planets, etc. so that the rule of nature could not be broken down. Tell me what happens when you stop worshiping trees and you cut it miserably? Best answer to this is there will be no rain. No rain, no crop. No crop, no food. No food: death. It means when rule of nature is broken, the nature takes its own course and spares nobody likewise when rule of law according to the Stephen Hawking is broken, the law takes its own course and spares nobody.

**** Definition of Secular*****

Now I think its a time to make the definition of SECULAR clear in real sense and I should publish my lecture on it... Secular is (s)he who has detachment of "religious foundation". According to Oxford Concise Dictionary of Politics-Indian Edition (2004)(pg.481) "... Among states where Christianity was the majority religion, the United States was unique in being secular from start by virtue of the First Amendment ('Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof...'). The secular institution of the state coexist with higher churchgoing and religious belief than in any other western democracy.

... The Indian Constitution (1949), written in the aftermath of the bloody partition which saw a predominantly Muslim Pakistan crated, opens with a statement that India is a secular republic. Under Nehru there was a clear commitment to a clear separation between the state and religion, and an avoidance of policies that discriminated on the grounds of religion. The Hindu nationalist movement has challenged what has been labelled 'pseudo-secularism', claiming that religious neutrality was neither possible nor desirable, and sought to promote a political agenda which recognizes Hindu history and values..."

To be secular is to maintain a naturalistic worldview in which belief in anything is always proportioned to the evidence available. It is about engaging in a variety of activities that are understood as this-worldly, and to identify with, or be a member of, non-religious groupings or associations. According to Cambridge dictionary, secular means religion has less and less influence on our daily lives. According to Oxford dictionary, it is a state of mind which is not subject to or bound by religious rule; not belonging to or living in a monastic or other order.

Freud "notes that 'civilization has little to fear from educated people and brain-workers' in whom secular motives for morality replace religious ones; but he acknowledges the existence of 'the great mass of the uneducated and oppressed' who may commit murder if not told that God forbids it, and who must be 'held down most severely' unless 'the relationship between civilization and religion' undergoes 'a fundamental revision'". (Wikipedia).

In the The Argumentative Indian, Mr. Amartya Sen devoted more than 20 pages on secularism where he writes, “Secularism in the political – as opposed to ecclesiastical – sense requires the separation of the state from any particular religious order. This can be interpreted in at least two different ways. The first view argues that secularism demands that the state be equidistant from all religions – refusing to take sides and having a neutral attitude towards them. The second – more severe – view insists that the state must not have any relation at all with any religion. The equidistant must take the form, then, of being altogether removed from each.

In both interpretations, secularism goes against giving any religion a privileged position in the activities of the state. In the broader interpretation (the first view), however there is no demand that the state must stay clear of any association with any religious matter whatsoever. Rather what is needed is to make sure that in so far as the state has to deal with different religions and members of different religious communities, there must be a basic symmetry of treatment.”

Mr. Donald E. Smith (2011) in his book, India as a Secular State, and Mr. Gerald James (2001) in his book, Religion and personal law in Secular India: A call to Judgement" writes secularism in India means equal treatment of all religions by the state. Unlike the Western concept of secularism which envisions a separation of religion and state, the concept of secularism in India envisions acceptance of religious laws as binding on the state, and equal participation of state in different religions. The Constitution of India has not defined any relationship of religion with state rather it is treating every citizen equal 
irrespective of cast, creed and religion.

Now coming to Social Harmony, it is peaceful interaction of human dynamics among members of a social group or groups. Basic survival and subsistence families or complex societies develop and thrive on some form of social harmony. Survival of social harmony is enhanced by productive exchanges of labor and production with divisions of labor increasing the benefits of social harmony.

Bihar Election: Only voters will loose...

Election is near in Bihar. Election commission has already announced the date of election which will start on 12th of October and ends on 5th of November 2015. The political parties are making all the possible promises of development which could be included in election manifesto but have we considered anytime why is Bihar lagging behind in Industrial development viz-a-viz national growth? No political party has ever tried to address this very question rather all are blaming one another for the same which is not true. The state’s industrial demography has been made from the 90s in such a way that the obstacle for establishing industrial set up is gigantic there. First of all, I could discuss about the policy paralysis of the government. I can enumerate like there is no (i) single window redressing system, (ii) Land Bank so that industry can get Land immediately without any public outrage, (iii) marketing potential of the bye/end product, (iv) mechanism for identifying industrial sickness, (v) transparency, (vi) stringent but easy RTI law, (vii) adequate basic infrastructure like transport, water and un-interrupted electricity supply and last but not least there is a few effective established industrial park. These are common deficiencies in policy of the government rather much of them are that the government has identified only nine sectors for its key thrust areas which are Food Processing, Agriculture based Industries, Tourism related Industries, Super Specialty Hospital, Higher/Technical Educational Institutions, Information Technology based Industries, Electronic Hardware Industry, Textile Industry and Energy/Non-Conventional Energy. These obviously not included heavy industry, automobiles and export intensive industry like gems & jewellery, petroleum, medicament, ship’s boats, textile yarn and organic chemicals etc.

The government has much focussed on the traditional sector which can be good and can certainly lead to much development without any bigger effort, but how? There is no clear policy which is implemented on ground level to boost agriculture as during Lalu’s rein agriculture was much sought after and it grew on an average 10% growth while industry was witnessing meager 3.5% growth. During BJP-JD(U) coalition government industry grew with an average 10% while agriculture with 3.5% which is nothing but structural change and it means NDA government has done nothing but structural change which cannot be said to be healthy steps to revive the economy rather it was an act of pouring milk from one container to another. It would have been better to keep the pace of agricultural growth on top gear; the industrial growth could be accelerated with extra effort. Now let us forget the past and coming back to policy.

Incentives on land, capital, plant and machinery, quality certification and reimbursement of VAT etc. are meager and could not attract much attention for large/mega project e.g. plant and machinery subsidy is only 20% subject to maximum of Rs. 5.00 cr. for large industrial unit and Rs. 0.75 cr. for MSME. There is no special incentive on income tax, service tax etc. which the state could have given from the devolution of the central Government receipt. Are these the only cause of slow growth? Answer is no. let us examine further.    

Law and order in Bihar has become a thing of media blind fold. Comparison from 2001 to 2011 is not so impressive. According to the Bihar Police Website, total crime reported in 2001 which includes Cognizable, Murder, Dacoity, Robbery, Burgling, Theft, Riots, Kid, K.R., Rape, R.D., RR, BD are BR are 128,487  while in 2011 it was  188,917 an increase in 47% over the year 2001. Media was much blind over the issue reason best known to them but surely NDA regime was not a golden period of Bihar rather it could be said a blot on the Bihar. General people were satisfied with glory and false report rather victims failed to get proper attention. Public can be fooled but not the think tank of large corporate. Their risk tolerance in terms of law and order is very low. In spite of these which are heart touching, the government also failed to do good deeds with the established industry. State government made little effort to expand petroleum refinery industry and revive sugar industry with a growth in technology and Sugarcane productivity.

It is matter of fact that the few sugar mills in Bihar have old technology and substitute for the same could be the same as that of establishment of new mills and hence government has no scheme for the same also. Either government can develop the project or transfer the same to strategic investors after negotiations. I in totality can say that in last 10 years, the government has not taken any step which could boost the industrial growth.

Seeking religion reason is of limited use for it is without foundation

I don't understand all should be painted with the same brush in a single colour. Telling that Muslim's religious institutions creates terrorism, why not Hindu, why not christian and any other religion on the earth. Terrorism has no value, no ethics, no humanity. Whether Religious Education is Constitutional in India or not?

Maharastra Govt. has denied to recognise  Madarsa which does not teach English, Maths and Science as its subject and the student passed out of it will be deemed to be "Out of School". It will be very interesting to see what constitutional support it takes as Madarsa in Maharshtra runs as a private institution which seems to be constitutional as per Article 30 (1) of the Constitution of India​ which clearly says, "All minorities, whether based on religion or language, shall have the right to establish and administer educational institutions of their choice." Hence, it is clear that the minorities of India has all the rights to establish educational institution of their own.

Maharashtra govt. is pleading that its intention is to bring students of Madarsa into "mainstream education" which likely to be somehow based upon the Article 16 of the Cosntitution but Article 16 (5) of the constitution says, "Nothing in this article or in sub-clause (g) of clause (1) of article 19 shall prevent the State from making any special provision, by law, for the advancement of
any socially and educationally backward classes of citizens or for the Scheduled Castes or the Scheduled Tribes in so far as such special provisions relate to their admission to educational institutions including private educational institutions, whether aided or unaided by the State, other than the minority educational institutions referred to in clause (1) of article 30." Stating more elaborately the State shall not have free authority to make any special provision relating to Madarsa and other such kind of minority run education institution.

Right to Education which is Article 21A of the Constitution of India states, "The State shall provide free and compulsory education to all children of the age of six to fourteen years in such manner as the State may, by law, determine." Here it is pertinent to understand the  definition of "State" according to the Constitution of India. Article 12 of the Constitution has broad definition of state when used in Parts III & IV of the Constitution and it says, "“the State’’ includes the Government and Parliament of India and the Government and the Legislature of each of the States and all local or other authorities within the territory of India or under the control of the Government of India." Now going to Article 44 of the Constitution which is nothing but a rudiment of India being a secular state defines, "The State shall endeavour to secure for the citizens a uniform civil code throughout the territory of India." Reading Article 44 of the Constitution, it is the duty of the state to protect all the rights of all the religion, languages and cultures in India.

Further Article 28 of the Constitution says,"(1) No religious instruction shall be provided in any educational institution wholly maintained out of State funds.

(2) Nothing in clause (1) shall apply to an educational institution which is administered by the State but has been established under any endowment or trust which requires that religious instruction shall be imparted in such institution."

Now let us understand the status of Madarsa in different states including Maharashtra.

In Maharashtra, the govt. has not recognized any board for Madarsa and it is running as private organisation under the State Wakf Board and mostly focuses upon religious education. There are 1889 Madarsas with approx. 1.5 Lac students out of which 550 are educating their pupil with English, Maths and Sciences and getting aid from the government.

In Madhya Pradesh out of 7000 Madarsas, 1500 are supported by the government aid. Here Madarsa Board conducts examination upto class VIII. Xth and XIIth Exams are conducted by Madhya Pradesh Open School.

In Gujarat, there are only 150 Madarsas which gives only religious education and have not been registered with the government. There are two types of Madarsas there; one which focuses only on religious education and another which gives primary education also. For first one, no need to get government approval but for second it needs to get permission. Two years before the then government offered these for Madarsa Board by the government  which they refused.

In kerela, Madarsas are very much advanced. In Bihar they educate their people with English, Maths and Science and related to Bihar State Madarsa Board.

Now coming to the conclusion, this proposal by the Maha. government that Madarsa which do not educate their pupil with English, Maths and Science shall not be recognised and their pupil shall be deemed to be "out of school" if dragged in the Apex court will yield very interesting result. Let us see if any one moves to the Hon'ble Apex Court against the proposal of the state government and what the Hon'ble Court rules. However the same step was taken by the Ashok Gehlot led Congress Government of Rajasthan and no one whispered anything upon it. Finger Crossed for Good outcome.
